Permit-Set Energy Compliance Terms & Conditions

    Effective Date: November 21, 2025 | Last Updated: October 9, 2026

These Terms & Conditions ("Terms") govern the submission of personal information, project details, drawings, and other materials ("Submitted Content") by individuals or businesses ("User," "You") to zHeight Inc., a California corporation ("zHeight," "We," "Us"). These Terms apply to in-house Title 24 energy compliance ("Title 24 Reports") prepared as part of our own ADU, JADU, addition and remodel permit sets. zHeight has paused standalone external Title 24 / CF1R services and does not accept T24-only requests.

    1. Acceptance of Terms

By submitting any project details or files to zHeight for in-house Title 24 preparation within your zHeight permit set, You agree to these Terms. If You do not agree, do not submit any materials.

    2. Required Information

For accurate in-house Title 24 calculations within your permit set, You may need to submit:

    • Personal contact information (name, email, phone)
    • Project address and property details
    • Architectural plans (PDF, DWG, sketches, elevations, sections)
    • Mechanical, electrical, and envelope specifications
    • Insulation values, window schedules, HVAC specs, appliance details
    • Photos or additional documentation required for modeling

You represent that the information You provide is accurate, complete, and legally yours to submit.

    3. Use of Submitted Content

You grant zHeight a non-exclusive, royalty-free license to use Submitted Content for:

    • Performing Title 24 energy modeling and calculations
    • Preparing compliance documentation (CF-1R and related forms)
    • Communicating with You or your design team
    • Internal quality assurance
    • Submitting energy documents to approved compliance registries (if applicable)

We do not sell or share your information outside the purposes listed above.

    4. Accuracy & User Responsibilities

To ensure accurate and compliant results:

    • You must provide complete and correct project information.
    • Any missing, unclear, or incorrect details may delay your Title 24 Report.
    • Changes to the design after submission may require a revised report and additional fees.
    • You must notify zHeight promptly of any design revisions that affect energy modeling (windows, HVAC, insulation, layout, square footage, etc.).

zHeight relies on the accuracy of your submission; we do not verify field conditions unless expressly contracted.

    5. No Guarantee of Permit Approval

Title 24 calculations are based solely on the information You provide.

    zHeight does not guarantee:

    • Permit approval by your city or county
    • Compliance if actual construction differs from submitted details
    • Approval if your jurisdiction requires additional corrections or documentation

Final approval is always at the discretion of the local building department and HERS requirements.

    6. Confidentiality & Data Privacy

zHeight will maintain the confidentiality of all Submitted Content and use it only for the purposes of Title 24 preparation and project communication.

We may share your information only with:

    • HERS providers or compliance registries, if required
    • Our vetted internal team or consultants preparing your energy model

We do not share or sell your information for marketing or unrelated purposes.

    7. Permit-Set Coordination

Title 24 compliance is prepared alongside the drawings within your zHeight permit set:

    • Timing follows the project schedule and depends on complete design information; no standalone report turnaround is offered

    Delays may occur if:

    • Information is missing or unclear
    • Plans change mid-process
    • Additional modeling revisions are requested

Any scheduling changes apply to the overall permit-set scope agreed for your project, not a standalone report service.

    8. Revisions & Changes

Your submission includes up to two (2) rounds of standard revisions for minor corrections.

A "revision" includes updates due to:

    • City plan check comments
    • Minor changes in window schedule, insulation, HVAC, layout, etc.
    • Correction of errors based on the same scope submitted originally

Major scope changes may require revised energy modeling within your permit set and an adjustment to the agreed project scope.

    9. Limitation of Liability

To the fullest extent permitted by law, zHeight is not liable for:

    • Delays caused by incomplete or inaccurate submissions
    • Rejection by permitting authorities due to incorrect information provided by You
    • Construction deviations from approved energy documents
    • Any indirect, consequential, or incidental damages

Your sole remedy for any dissatisfaction is discontinuation of the applicable permit-set services.

    10. No Engineering or Structural Certification

The Title 24 Report provided by zHeight is:

    • An energy compliance analysis, not structural or mechanical engineering
    • Not a substitute for design review, architectural oversight, or code compliance verification beyond energy requirements

You remain responsible for ensuring all other code sections are met.

    11. Accuracy of Information

You confirm that all information you provide is true, accurate, and complete to the best of your knowledge.

    12. Permission to Contact You

You consent to be contacted by zHeight Inc. via email, phone, or other contact methods you provide, for the purpose of responding to your inquiry and any related follow-up.

By submitting this form, you also consent to receive marketing and promotional communications from zHeight Inc., including updates about services, offers, and relevant content. You may unsubscribe from these communications at any time by using the unsubscribe link in our emails or by contacting us directly.

    14. No Confidential Relationship

Information submitted through this form is not treated as confidential or privileged. Please do not share sensitive personal, financial, or security information (e.g., passwords, bank details).

    15. No Legal / Professional Advice

Any information or guidance provided in response to your message is for general informational purposes only and does not constitute legal, financial, or professional advice.

    16. Data Use & Privacy

Your information will be handled in accordance with our Privacy Policy. Please review our Privacy Policy.

    17. No Guarantee of Response or Outcome

While zHeight Inc. aims to respond promptly, we do not guarantee a response, a specific response time, or any particular outcome as a result of your inquiry.
