New 2026: Solar Required on Detached ADUs

Santa Clara's Reach Code (Ordinance 2081) requires solar panels on all newly constructed detached ADUs effective January 1, 2026. Solar panels can be placed anywhere on the property — not only on the ADU roof. Garage conversions, attached ADUs, and JADUs are NOT subject to this requirement. Factor solar into your construction budget and structural planning.

    Eligible Zones

ADUs are allowed in R1-6L, R1-8L, R2, R2-7L zones. No minimum lot size. State law requires ADUs anywhere single- or multi-family housing is permitted.

    Flood Zone & Historic Properties

Properties in flood zones are not eligible for the pre-approved ADU plan program — a custom design is required. Verify flood zone status for your parcel before selecting a plan. Historic properties are not eligible for the pre-approved ADU plan program. Custom design required with additional review. Custom design required in both cases.

    No Owner-Occupancy Required

California removed the owner-occupancy requirement in January 2020 (SB 13). You can build an ADU on a rental or investment property in Santa Clara.

    ADU Types & Sizes

What Can I Build on My Santa Clara Lot?

Santa Clara allows four ADU types. Sizes are governed by Santa Clara Zoning Code Chapter 18 with a state-law floor of 800 sqft the city cannot go below. New detached ADUs require solar panels per the Santa Clara Reach Code (Ord. 2081, Jan 2026).

    Permit Process

How to Get an ADU Permit in Santa Clara

Permits are submitted online through Accela Citizen Access . Standard review runs 6–16 weeks; the AB 1332 pre-approved plan track targets 10 business days for qualifying plan sets.

    AB 1332 Pre-Approved Plans — 10 Business Days

Santa Clara's pre-approved ADU plan library qualifies for a 10-business-day review with no additional plan review fee. Eligibility: existing single-family home or duplex, not in a flood zone, not a historic property. Visit santaclaraca.gov for the current plan library.

    #1: Incomplete site-specific plans

Inaccurate utility details, incorrect solar placement, or setback errors that don't reflect the actual lot conditions cause plan check rejections. Verify parcel conditions before drawing.

#2: Height mismatch triggers Architectural Review

Second-story ADUs that don't match the primary home's height cannot use the fast ministerial track — they require Architectural Review, adding 2–3 weeks. Design to match the existing roof height for streamlined approval.

    1. 01

      Feasibility & Zone Check

Confirm zoning (R1-6L, R1-8L, R2, R2-7L), setbacks (4 ft side/rear), and property eligibility. Verify the property is not in a flood zone or designated historic — these are NOT eligible for the pre-approved plan program. Contact Planning at (408) 615-2450 with your parcel number for a quick eligibility check.

    2. 02

      Evaluate Pre-Approved ADU Plans

Santa Clara's AB 1332 program offers 10-business-day review for qualifying plans with no additional plan review fee. Visit santaclaraca.gov for the current pre-approved plan library. If your lot qualifies, zHeight builds the complete site-specific permit package around a pre-approved design — adding structural calcs, Title 24 CF1R, and solar layout.

    3. 03

      Design & Engineering

Full permit-ready plan set: architectural drawings, structural calculations, Title 24 CF1R. For new detached ADUs, include solar panel layout — required by Santa Clara Reach Code (Ordinance 2081) as of January 1, 2026. Solar panels may be placed anywhere on the property, not only on the ADU roof.

New detached ADUs built after Jan 1, 2026 must include a solar panel system per Santa Clara Reach Code. Factor solar into your construction budget and structural planning from the start.

    4. 04

      Second-Story Height Alignment

If designing a second-story ADU, ensure the ADU height matches the primary home's height for ministerial (streamlined) approval. A height mismatch triggers Architectural Review instead — adding 2–3 weeks to the timeline and introducing design discretion. Plan your roofline to match the existing structure.

    5. 05

      Submit via Accela Citizen Access

Apply online at santaclaraca.gov through Accela Citizen Access. Upload all plans digitally. Pre-approved plans with a complete submittal: 10 business days. Cost Guide

How Much Does an ADU Cost in Santa Clara?

ADU costs break into three buckets. New detached ADUs in Santa Clara require solar panels — factor $8,000–$15,000 into your construction budget. Ranges below are Bay Area market estimates.

    Design & Engineering

    $7,000 – $16,000+

zHeight flat-fee or custom quote. Includes architectural plans, structural calculations, Title 24 CF1R, and solar panel layout (required for new detached ADUs). Solar coordination adds to the higher end.

    City Permit Fees

    Contact Permit Center

No additional plan review fee for pre-approved ADU plans. Standard permits are valuation-based. Call the Permit Center at (408) 615-2490 for current fee schedule before budgeting.

    Construction

    $300 – $500+ / sqft

Paid to your licensed general contractor — not zHeight. Detached ADUs typically run $200K–$500K+ total. New detached ADUs must include a solar system — budget an additional $8,000–$15,000 for panels. Conversions cost less.

Solar System Cost — New Detached ADUs

Santa Clara's Reach Code (Ord. 2081) requires a solar panel system on all newly constructed detached ADUs built after January 1, 2026. Typical solar system cost for an ADU: $8,000–$15,000, depending on system size and roof/panel placement. Panels may be placed anywhere on the property — placement on the main house roof is acceptable. Factor structural load analysis into your permit package if placing panels on an existing roof.

    Verify Permit Fees Before Budgeting

The City of Santa Clara uses a valuation-based permit fee schedule. There is no additional plan review fee for pre-approved ADU plans. ADUs under 750 sqft are exempt from school and park impact fees under SB 13. Call the Permit Center at (408) 615-2490 for current fee amounts before you finalize your budget.

    Why zHeight

Pre-Approved Plans vs. a Complete Permit Package

Santa Clara's AB 1332 pre-approved plan library is a genuine head start. Here's exactly what they include — and what still requires site-specific work before Accela will accept your submission. New detached ADUs also require a solar panel layout.

Pre-approved plans are a real option. Santa Clara's AB 1332 program offers a pre-reviewed plan library with no additional plan review fee and a 10-business-day review track. If a pre-approved plan fits your lot, zHeight can assemble the site-specific permit package around it — adding structural engineering, Title 24 CF1R, solar panel layout, and Accela submission — rather than starting from scratch.
